What is NOM-036-1-STPS-2018 about and what does it consist of?

De-que-trata-la-norma-035-stps-2018

On January 2, 2020, the NOM-036-1-STPS-2018 came into force on occupational safety. It is an occupational safety standard to prevent ergonomic risk factors. These include physical exertion, repetitive movements, and strained postures, for example.

It is a law thought of improving the labor well-being of business collaborators where conditions of respect for the integrity of employees are stipulated in order to maintain a optimal work environment and avoid ergonomic risk factors, that is, caused by greater physical effort, repetitive movements or forced postures, in each member of the company, what is intended is to find a balance between life and work.

This occupational safety standard should not be confused with theNOM-035-STPS-2018, to which it was stipulated to take care of mental health and psychosocial risk factors, but it complements it totally in order to reduce diseases caused by daily tasks at work.

What benefits will you have from a good implementation?

It is estimated that in the last decade, muscle diseases, fractures or injuries on the job have doubled. Because of this, NOM 036 could help reduce this class of muscle-skeletal disease and disorders, which represent the 42% of the most common ailments in employees.

According to the Secretaría de Trabajo y Previsión Social (STPS) The new rule is expected to have positive effects in the sectors where physical risks are generated the most, such as transportation and cement industries as well as corn, sugar and wheat milling industries. Consequently, the standard is expected to be implemented in more than 14,000 work centers in the country where manual labor of great effort is carried out daily.

Avoid fines

Being enforceable, the NOM 036-1 STPS 2018 contemplates a fineIn case of non-observance, it can be up to500,000.00 pesos per violation, that is, per worker.
